Welcome to the Ruffulo v. Farmers Settlement Website
The Court has preliminarily approved a proposed settlement in this case (the “Settlement”) involving claims against Farmers Insurance Exchange, Farmers Group, Inc., Truck Insurance Exchange, and Fire Insurance Exchange (collectively “Defendants”) brought by named Plaintiffs James Ruffulo and Valerie Yankus (“Plaintiffs”).
There are two classes in this Settlement, the FLSA Collective and the FEHA Class. You may be a member of one or both Settlement Classes. The Settlement Classes are defined as follows:
- FLSA Collective: The Settlement covers anyone who (i) signed a Farmers Agent Appointment Agreement or a Farmers Corporate Agent Appointment Agreement not containing an agreement to arbitrate; and (ii) worked as a Farmers agent or Supervising Agent for an incorporated Farmers agency outside of the state of California at any time between March 9, 2020, and September 30, 2025 (the “Settlement Class Period”) (these individuals are referred to as the “FLSA Collective Members”).
- FEHA Class: The Settlement covers anyone who (i) signed a Farmers Agent Appointment Agreement or a Farmers Corporate Agent Appointment Agreement; (ii) worked as a Farmers agent or Supervising Agent for an incorporated Farmers agency outside of the state of California at any time between March 9, 2020, and September 30, 2025 (the “Settlement Class Period”); (iii) whose appointment was terminated by Farmers in connection with the Managing Underperforming Agents Process (as defined in Section 1.2 of the Settlement Agreement); and (iv) who was 40 years of age or older on the effective date of their appointment’s termination (these individuals are referred to as the “FEHA Class Members”).
If you are a FLSA Collective Member, you will have to opt in to be included in the Settlement and receive a payment if the Settlement is approved by the Court. If you are a FEHA Class Member, you will be automatically included in the Settlement and will receive a payment if the Settlement is approved by the Court, unless you choose to opt out. The Court has yet to approve the Settlement and the requested attorneys’ Fees, Awards, and Expenses. No Settlement benefits will be provided unless the Court approves the Settlement.
